GENERAL TERMS AND CONDITIONS

Unless we state otherwise on a particular Shopify or eBay page, all of Draco Products' sales (Auctions and Buy-it-Now) are subject to the following general terms and conditions. PLEASE DO NOT BID OR PURCASE on any of our items without first reading these terms and conditions, as once you have placed a bid you will be bound by them.

Condition; Item Description. We have done our best to reveal the material condition of offered piece in sufficient detail. We are not experts in this type of general merchandise; accordingly, if any item is not "as described" in our sales page, your sole recourse is to ask for a refund under our "Return and Refund Policy," described below. In no event will we be responsible for any defects in condition that are either disclosed in our item description or are clearly depicted in our auction photos.

WE DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, OR STATUTORY, REGARDING ANY ITEM SOLD ON THE SHOPIFY, OR EBAY, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some jurisdictions do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights that vary from jurisdiction to jurisdiction.

Return and Refund Policy: We offer a 30 day customer satisfaction guarantee or your money back (Buyer is responsible return shipping). If you don’t get the item you ordered, or the item is determined by the seller to be defective merchandise or if it was not as described we send out an immediate replacement or once item is returned in the same original condition buyer is issued money back (Seller is responsible replacement or return shipping). ALL SALES ARE FINAL. Requests for returns or refunds made after (60) days following sales closing date will be honored only in our sole discretion of seller.

 

Concerns or Questions. If you question or issue regarding your transaction please CONTACT US FIRST before leaving feedback to RESOLVE any issue directly:  Draco-Product. When we resolve an issue give you a refund you agree not to post "negative" or "neutral" feedback for the transaction, and neither will we.

Payment. Immediate payment is required through PayPal or Credit Cards Visa/MasterCard, Amex, Discover, processed by PayPal unless we indicate otherwise in a particular auction page.

Shipping and Handling Charges. The winning buyer, if located in the United States, will pay a "shipping and handling charge" listed in particular page with delivery confirmation, in highly protective packaging, and care in handling. This fee is based on aggregate of our actual costs of shipping and handling.

The winning bidder, if located outside of the United States, we ship worldwide included through eBay “Global Shipping Program”. When you place the order we ship the item to eBay and they send it to you.  Seller does not profit from eBay international shipping charges and delivery may take several weeks as the shipment may go through several different carriers to reach delivery.

Shipping Schedule. We typically ship next business day of receipt of payment unless stated in the listing.

Insurance. You may request USPS insurance unless it is stated in the listing to be included. If we do not offer insurance as an option on any item, you may nonetheless ask us to insure delivery for an additional fee. 

Risk of Loss. We pack all items with great care, and will assume all risk of loss until we deliver the item to a "common carrier" (such as the U.S. Postal Service, UPS, Federal Express, or Airborne Courier). We will provide proof of delivery to a "common carrier" to you upon you, along with tracking numbers. In the unlikely event that the item is lost, damaged, or destroyed before we deliver it to a "common carrier," our only liability or obligation to you will be to refund promptly any monies we have received from you.

At the moment we deliver the item to a "common carrier," risk of loss in the item shifts from us to you. We strongly recommend that you purchase insurance for items over $ 50 or whatever amount represents an unacceptable loss to you, because if you opt not to insure, WE WILL NOT BE RESPONSIBLE FOR ANY LOSS, THEFT, OR DAMAGE TO ANY ITEM AFTER DELIVERING THE ITEM TO A "COMMON CARRIER" AS DESCRIBED ABOVE.

Sales and Use Taxes. State and local sales taxes will be added to your winning bid if you live in any of the following states: ,

Note to Overseas (Non-U.S.) Buyers. You are responsible for any Value-Added Tax (VST), General Sales Tax (GST), customs duties, and other taxes, payments, and impositions required by the law of your country.

We are not a "commercial vendor" in any country other than the United States of America, and are accordingly not obligated to comply with any laws, rules, license requirements, or regulations in your country unless we are advised otherwise by our legal counsel. The U.N. Convention on Contracts for the International Sale of Goods shall not apply to any of our auctions or sales on eBay.

Restricted Bidders. We do not honor bids or sales from "nonpaying buyer", with policy violations, no PayPal account, or countries we do not global ship to. If you fall into any of these categories please do not bid or purchase on any of our items.

We reserve the right not to honor bids or sales from eBay members with no successful purchases (0) or a feedback rating below 100% positive.

Communications to Seller. All communications to us should be sent to the following e-mail address: Draco-Product. We will use our best efforts to respond to all e-mail communications within twenty-four (24) hours of receipt. Any additional information we provide you about a particular item may, at our discretion, be posted to our auction page or otherwise made public for the benefit of all bidders.

LIABILITY LIMITS. WE DISCLAIM ALL CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES OR LOST PROFITS ARISING OUT OF OR IN CONNECTION WITH Sopify or eBay Sales (HOWEVER ARISING, INCLUDING NEGLIGENCE). OUR TOTAL LIABILITY TO YOU IS LIMITED TO $100.00 US Dollars. Some jurisdictions do not allow the foregoing limitations of liability, so they may not apply to you.

ENTIRE AGREEMENT/AMENDMENT.  This Agreement contains the entire agreement between you and us.

Disputes. In the event of any dispute involving one of our eBay auctions, you agree to submit the dispute to eBay's SquareTrade mediation service before leaving "negative" or "neutral" feedback for us on eBay's Feedback Forum or pursuing any other legal remedy. By bidding in any of our auctions or sales, you irrevocably agree that any dispute, conflict, or controversy between you and Draco Products will take place only in a court of law located in County of Duval, State of Florida, United States of America, and will be governed by the laws of the State of that apply to contracts between residents of that State.
